Article 1 — Definitions
The following terms are used in these terms and conditions:
- Healthy Peptides — the trading name of the business operating the website healthy-peptide.com and offering peptide products for scientific research.
- Customer — any natural or legal person placing an order via the website and thereby entering into an agreement with Healthy Peptides.
- Product — peptides and related substances intended exclusively for in-vitro scientific research and laboratory practice.
- Website — the online shop environment accessible via healthy-peptide.com and all associated subdomains and digital channels.
Article 2 — Applicability
These terms and conditions apply to all offers, orders and agreements concluded via the Healthy Peptides website. By placing an order the customer declares that they have read these terms and expressly agree to them.
Deviations from these terms are valid only if agreed in writing with Healthy Peptides. Any purchasing or other terms of the customer do not apply, unless Healthy Peptides has expressly accepted them in writing.
Healthy Peptides reserves the right to amend these terms. The most current version is available on the website at all times. In the event of an amendment, the version in force at the time of ordering applies.
Article 3 — Products & Use
All products offered via the website are intended exclusively for scientific in-vitro research in a laboratory setting. The products are expressly not intended for human or animal consumption, diagnostic use, therapeutic application or any other use outside a research context.
By placing an order the customer confirms that they:
- Are at least 18 years old and legally competent under the law of their country of residence.
- Will use the products solely for scientific research and not for consumption, self-medication or resale as a consumer good.
- Are aware of the laws and regulations in force in their country regarding the purchase and possession of the substances ordered.
Healthy Peptides reserves the right to refuse or cancel orders where there are reasonable grounds to believe the products are not being purchased for research purposes.
Article 4 — Orders & Payments
An agreement is concluded at the moment Healthy Peptides sends an order confirmation by email to the address provided by the customer. The customer must enter this email address correctly; Healthy Peptides is not liable for non-receipt of a confirmation resulting from an incorrectly provided address.
Payments are processed via a secure payment service provider. The customer may choose from the payment methods offered during checkout, including iDEAL, credit card, Bancontact and bank transfer. All transactions take place over a secure SSL connection.
Prices on the website include VAT unless expressly stated otherwise. Healthy Peptides reserves the right to change prices; the price applying at the time of ordering is binding.
Article 5 — Delivery
Healthy Peptides aims to process and dispatch orders within 1–2 business days of receiving payment. Delivery times are indicative and confer no right to compensation if exceeded, unless there is intent or gross negligence on the part of Healthy Peptides.
- Free shipping is offered on orders from € 75.00. Below this amount, shipping costs are charged as stated during checkout.
- Delivery takes place exclusively within the European Union. Orders with a delivery address outside the EU will not be processed.
- The risk of loss or damage passes to the customer at the moment the shipment is handed over to the carrier.
If nobody is home, the shipment is offered at a collection point. The customer is responsible for timely collection. Parcels returned to Healthy Peptides due to non-collection may be reshipped at the customer's expense.
Article 6 — Right of withdrawal
Under Article 16(e) of European Directive 2011/83/EU (and its implementation in the Dutch Civil Code), the right of withdrawal is excluded for goods which for reasons of health protection or hygiene cannot be returned and whose seal has been broken after delivery.
Peptide products are supplied in sealed packaging. Once the seal has been broken after delivery, the right of withdrawal lapses. The customer therefore has no right to return or refund for opened or used products.
Notwithstanding the above, the customer is entitled to replacement or a refund if a product is demonstrably damaged or incorrectly delivered. Such claims must be reported within 48 hours of receipt via [email protected], accompanied by photographic documentation.
Article 7 — Liability
Healthy Peptides is liable only for direct damage that is the immediate consequence of a shortcoming attributable to Healthy Peptides, and only up to the amount covered in the relevant case by its liability insurance or — failing such cover — up to the invoice amount of the order concerned.
Healthy Peptides is expressly not liable for:
- Damage resulting from use of products outside the intended research context, including human or animal consumption.
- Consequential loss, lost profit, missed savings or damage due to business interruption.
- Damage arising from incorrect or incomplete information provided by the customer when placing the order.
The limitations set out in this article do not apply where the damage results from intent or wilful recklessness on the part of Healthy Peptides or its executives.
Article 8 — Privacy
Healthy Peptides processes customers' personal data in accordance with the General Data Protection Regulation (GDPR). For a full description of what data is collected, how it is used and what rights the customer has, please see our detailed privacy policy.
By using the website and placing an order, the customer consents to the processing of their personal data as described in the privacy policy.
Article 9 — Complaints & Disputes
Complaints about products or the services of Healthy Peptides must be reported in writing as soon as possible, and at the latest within 14 days of the complaint arising, via:
Healthy Peptides aims to respond to complaints within 14 business days of receipt. If a complaint requires a longer processing time, the customer will receive an acknowledgement within 14 business days indicating the expected resolution period.
All agreements between Healthy Peptides and the customer are governed exclusively by Dutch law. Disputes that cannot be resolved by mutual agreement will be submitted to the competent court in the district where Healthy Peptides is established, unless mandatory provisions designate a different court.
Consumers also have the option of submitting disputes to the Dutch Disputes Committee or using the European Commission's ODR platform (ec.europa.eu/consumers/odr).
